These Terms of Service ("Terms") govern your use of the Grand Tracker progressive web application and the website at grandlakeapp.com (the "Service"), operated by Grand Tracker ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Description of Service

Grand Tracker is a progressive web application that provides information about Grand Lake O' the Cherokees, Oklahoma, including but not limited to:

Lake conditions (pool elevation, water temperature, dam discharge)
Weather forecasts and alerts
Interactive maps with points of interest
Restaurant and business listings
Event calendars
Fishing conditions and solunar data
Push notifications for weather and lake alerts

2. Accuracy Disclaimer

⚠️ CRITICAL SAFETY NOTICE: Lake conditions, weather data, water levels, dam discharge rates, and related information displayed in this app are sourced from third-party providers (USGS, National Weather Service, GRDA, Open-Meteo) and may be delayed, inaccurate, or unavailable. Never rely solely on this app for safety-critical decisions. Always check official sources and exercise personal judgment when boating, swimming, or engaging in water activities.

We make reasonable efforts to display accurate information but we do not guarantee the accuracy, completeness, timeliness, or reliability of any data, including but not limited to:

Pool elevation and lake levels
Weather forecasts and severe weather alerts
Water temperature and dam discharge rates
Fishing conditions and solunar bite predictions
Restaurant hours, ratings, and open/closed status
Event dates, times, and details
AI-generated search results and summaries
Lightning strike data and proximity alerts

⚡ Lightning Data Disclaimer: Lightning strike data is sourced from Blitzortung.org, a third-party community-based lightning detection network. This data may be delayed, incomplete, or inaccurate. Lightning alerts are provided as a convenience only and should never be relied upon as your sole source of lightning safety information. Always monitor official weather sources (NWS, NOAA) and follow standard lightning safety practices: when thunder roars, go indoors.

3. Assumption of Risk

Water activities are inherently dangerous. By using this Service, you acknowledge that boating, fishing, swimming, and other water activities carry risk of serious injury or death. You assume full responsibility for your safety. Always wear a life jacket, check conditions from multiple sources, and follow all posted regulations and warnings.

4. Subscriptions and Payments

Grand Tracker Pro is an optional paid subscription that unlocks additional features. By subscribing, you agree to:

Recurring billing: Subscriptions automatically renew monthly or annually until canceled. You will be charged at the beginning of each billing period.
Pricing: Current pricing is displayed on the subscription page. We reserve the right to change pricing with 30 days' notice.
Cancellation: You may cancel at any time by emailing howdy@grandlakeapp.com. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
Refunds: Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge to request a refund.
Payment processing: All payments are processed securely by Stripe. We do not store your full credit card details.

5. Acceptable Use

You agree not to:

Attempt to bypass, circumvent, or reverse-engineer the subscription system
Scrape, crawl, or programmatically access the Service without permission
Use the Service for any unlawful purpose
Attempt to interfere with or disrupt the Service
Share, redistribute, or resell access codes or subscription credentials
Misrepresent your identity or affiliation

6. Intellectual Property

The Service, including its design, code, content, graphics, and branding, is owned by Grand Tracker and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Third-Party Content and Services

The Service incorporates data and services from third parties including:

United States Geological Survey (USGS) — lake gauge data
National Weather Service (NWS) — weather forecasts and alerts
Grand River Dam Authority (GRDA) — lake operations information
Open-Meteo — supplemental weather data
Anthropic (Claude AI) — AI-powered search and summaries
OpenStreetMap / Esri — map tiles and imagery
Blitzortung.org — community-based real-time lightning detection data

We are not responsible for the availability, accuracy, or terms of these third-party services. Their respective terms and policies apply to their data. For the full list of sources, the data we display from each, and links to the authoritative original, see our Data Sources page.

8. Restaurant and Business Listings

Restaurant hours, ratings, descriptions, and contact information are provided as a convenience and may not be current. We recommend calling ahead to verify hours, especially during holidays and off-season. Featured/advertised listings are clearly marked and represent paid placements.

9. AI-Generated Content

Certain features use artificial intelligence (Anthropic Claude) to search for and summarize information. AI-generated content may contain inaccuracies, outdated information, or errors. Always verify AI-generated information independently before making plans or decisions.

10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, Grand Tracker, its owners, operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, lost profits, or data loss, arising from or related to your use of the Service.

This includes, without limitation, any damages resulting from reliance on lake conditions, weather data, navigation information, water levels, fishing conditions, or any other information provided through the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Indemnification

You agree to indemnify, defend, and hold harmless Grand Tracker, its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the State of Oklahoma.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
